Hi,

I am currently on H3 visa. My 2-yr term is coming to an end. My company had initially told me that they would find me a job internally and then relocate me to another location outside of the US after my training ends.

However, the company has not been able to find me anything in other regions, which essentially means I will be laid off. I want to know if the company is liable to pay me severance / air tickets back to my home country??

My employer is currently saying that they are not responsible for my airfare. That provision is only for H1B's. However, if the intent of H3 visa was to bring me for training and transfer me so that I could use that knowledge somewhere else. Even in the H-3 filing papers my company stated that their intent was to provide me employment in other regions after the end of the training. I don't understand how can they leave me stranded. They should be liable for something (severance, airfare)??

Please reply if you have any advice.

Completed my 6 years on H1B and returned back to India on personal reasons.

1. When I apply for a new H1B after 1 year break, does the H1B comes under the quota or will it be considered on previously held H1B quota.

2. How sure about getting approval of H1B.

Hi Gurus,

Request your help on my query. I am on H1B with an I 797 valid upto 29-Jan-2011 and dependants have stamped H4 visas valid upto 29-Jan-2011. My company is in the process of applying for my H1B extension (this will be my second extension and i have currently completed 4 yrs 9 months in US).

My dependants are planning to travel to India at the end of this month and plan to return back by end of Nov. Will they face any issues during their return at POE ?

Will there be any complications with our visa extensions ?

Appreciate your response at the earliest.

I applied for H -1 extension regular processing in the month of sept 2009 in california service centre before expiration date of my H1-B(2010 Jan 22).I got RFE on DEC 18th asking for client and contractual agreements between client and vendors and i got time til Jan 29th 2010 to reply back to RFE.As i was preparing to collect all the documents to respond to my RFE ,I also applied new H 1 from same existing employer before Jan22nd 2010 in Vermont service centre.I replied back to RFE on jan 27th 2010 with client letters and letters from 2 vendors.
I got my H 1-b extension approved from California service centre on Feb 18th 2010

My question is what if my new H1 filed in vermont service centre gets rejected.Will it cause any problems to the extension that was approved.I already got my h1-b extension approval notice from uscis on FEB 18th 2010.I have'nt heard anything about my new h1 b filed on jan 21 2010 in vermont service centre.Can i continue to work on my approved extension.
Please advice me

Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.

I just don't want to spend those $5,500 can this lawyer is asking me for his services, I appreciate very much your replies and my family will too

The USCIS announced today, April 27, 2009, that it has received approxiamtely 45,000 H-1B petitions counting toward this fiscal year's general cap of 65,000. Therefore it will continue to accept H-1B petitions that are subject to the general cap.

Then USCIS also announced that it has received approximately 20,000 H-1B petitions for aliens with U.S. advanced degrees subject to the 20,000 advanced degree cap. However, the USCIS says it will continue to accept additional advanced degree petitions because it knows from past experience that some number of the advance degree petitions are not approvable for any number of possible reasons.

I will update this blog on the H-1B account as soon as the USCIS makes further announcements.

Hi,

I got RFE on Advance Parole requesting proof that I have complied with NSEERS.

All I know is I went for Special Registeration back in 2003 when it initially started and citizens of specific countries were required to go for that special registeration. The immigration officer stamped my I-94 and wrote a FIN# on my passport and I-94.

Last time I travelled out of US was back in May 2001 for couple of weeks.

Now got this RFE any idea what do I need to submit.

I have my Perm approved and my PD became current so i'm able to file I-485 but i have a couple of questions.

My fiancee was in US on J1 with 2 year HRR that is not up until Jan 15, 2008. She has been back to the US twice since she left (Jan 15, 2006) on B1/B2 visa. We plan to get married. When should we do it for her to be able to come to the US under my I-485 when her 2year HRR is up.

Please advise. I just sent an e-mail to my attorney but she's on vacation until Jun 19... I guess i'm too anxious to find out what my options are.

HI,

I have an H1b approval notice but as it clear the duration of the visa validity starts in October, today being 27 june and three months away from start of visa duration can i travel to India next month ( july) and be back in August as i am still on OPT and working full time in America now. I have got an oppointment with a consulate in India. Once i have got a stamp on my passport will i be permitted to enter back immediately or only in october, i need to make decision to travel now or later as if i am allowed back immediately it will affect my work.

The questions is, if i have an approved I-140 from Company A and I switch over to Company B, then would i be able to file my 485 based on 140 related to Company A when my PD for Labor (company A) becomes current.
