Can this event set a precedent for Western Immigration programs to treat people fairly ?
A similar thing had happened in the past when Canadian Immigration Agency increased the eligibility pass mark. Six months later a court ruled that they have to accomodate those who are already in the system.
I wonder if this open a judicial precedent for unjust affect of 245(i) on all of us. Interesting enough, UK skilled immigrants also have something similar to immigration voice.

I came to the U.S when i was 12 from germany on a vwp and have stayed here ever since i'm 21 years old now married to a U.S citizen, I have all the papers filled out ready to send to the USCIS for AOS thru marriage to a us citizen but our attorney has warned us that there has been recent denials in these types of cases Im very terrified and clueless i dont know if i should proceed and go for it or just wait and see if anything changes.
Please let me know if you or someone you know has gone thru this.

New numbers are out on H-1B usage and the past week showed a substantial pickup in usage with more than 1700 numbers counted against the cap of 65,000. 36,600 H-1Bs have been counted now. I'm moving my exhaustion projection date up about two weeks. My target is based on a rolling four week usage average so variations from week to week are discounted. Keep an eye on the military appropriations bill Congress is working on for a potential immigration piece. The AP reports that Republicans want some serious money and personnel commitments for the southern border. And my own sources are telling me that some Democrats are looking at trying to get the DREAM Act in that same piece of legislation. Remember, DREAM allows for some who join the military to pursue permanent residency so it would be a germane part of the bill. A down payment on comprehensive immigration reform? Or the end of that effort and the return to piecemeal legislating?...

IV Team,
I'd filed my concurrent EB2 I140+I485 on Aug 17, 2007 at the Texas Service Center. I have been trying to check the status of my I140 petition online for the last 3-4 months. Every time i try to do so, i get the following error message:
"Case Status Retrieval Failed. This Receipt Number cannot be found at this time in this automated system"
Am I the only one with this problem ? or are there others experiencing the same issue ?

If the H1-B came with I-94 attached to the I797 form, then your status would be H1-B from the day written on the I-94 form. From that day, you cannot work with the employer A without filing another H1-B with employer A.

I am on L1B visa from Apr 2008. I have my PERM and I140 approved.
I got a email from my attorney stating that they want to file my H1B petition this year so that they can keep on renewing my H1b as long as my company wants.
Suppose they file H1B COS petition then my status will automatically change on Oct 1 2010.
I am planning a vacation to India in November 2010, what are the options with me when come back to US.
- Do i have to stamp the H1B visa OR
- I can still come back on my existing L1B visa ???
Please suggest

Hello
We moved to a new location after filing our 485, EAD and AP petitions. We immediately sent the AR11 forms (by Fedex) and also did the AR 11 form online. Apart from this we updated the addresses for all pending petitions.
The status is as follows:
1. My wife's EAD went to the old address and fortunately USPS forwarded to our new address. However my EAD has not yet reached me though when I check online it looks like it was approved on 1st Oct. How do we track this?
2. I have received the address change confirmations from USCIS for my 485 petition. I have not received the same for my wife and daughter's petitions. Do I have to go and update the address change once again online?
Kindly advice based on your experience.
